From the paper the Calgary Sun comes this story about Elder Abuse. The story says the lack of regulation of senior care staff is a drawback in facilities like the one where a Calgary senior was assaulted by three of his attendants, a city police officer said Friday.

Such workers aren’t bound to standards hospital workers are subject to, said Smiley of the force’s Elder Abuse Response Team (EART).

“At care facilities, it’s up to each organization to set the standard and there can be a high turnover.”

EART, formed in 2011, doubled its staff to four last January after handling 150 investigations last year, said Smiley.

But he said 80%-90% of complaints they receive involve abuse committed by family members, with the majority of it occurring in private homes.

Illinois Latest State To Consider Hidden Cameras In Nursing Homes

According to this story in the Fiscal Times Illinois Atty. Gen. Lisa Madigan has heard enough elder abuse nightmare stories that she is drafting legislation will be introduced in 2015 that will allow Illinois nursing home residents and their families to put cameras in their rooms to help protect them.

“Residents and family members should have the option, for their own peace of mind, to monitor what is taking place,” said Madigan. “If something goes wrong, you can see what actually happened.”

Four other states -New Mexico, Oklahoma, Texas and Washington-allow residents to maintain cameras in their rooms. In Maryland, cameras can be placed in a resident’s room, but only if the facility permits them, according to state guidelines.

While no one keeps data on the total number of allegations of abuse or neglect in nursing homes, an August report by the U.S. Department of Health and Human Services Inspector General’s office found that 85 percent of nursing facilities reported at least one such allegation to the agency in 2012. It estimated that about 60,000 allegations involved staffers abusing or neglecting residents.

About 1.5 million people reside in nearly 16,000 nursing homes nationwide at any given time.

Here is a story from across the pond in England in the Journal called Socialist Health about elder abuses here in the United States. Not that they don’t have them in England-they do.

The gist of the story is a group of eight nurses and nine certified nursing assistants were fired in a New York State investigation that showed neglect of duty and making false records. Patients in nursing homes are among the most vulnerable citizens for obvious reasons. The Atty. Gen. in New York used hidden cameras to reveal the mist treatment of patients in two facilities.

As far as we know Oklahoma was the first state to legalize the use of hidden cameras in nursing homes. Ohio and New York followed suit. It is expected that other states will follow this trend.

In Ohio cameras can only be installed by relatives. Ohio and New York are single consent jurisdictions meaning that if the patient or their legal representative consents to the use of the camera no other consent is needed. However a prosecutor can install a hidden camera without a court order or subpoena and the nursing home or hospital need not be told of the surveillance camera.

We feel this action is long overdue can urge other states to follow. This action may not put an end to elder abuse, but it will send a clear message that if you do abuse patients in a nursing home you will get caught and prosecuted.
